Welcome to JamSetlist. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use JamSetlist.

These Terms constitute a legally binding agreement between you and JamSetlist. Please read them carefully.

2. Description of Service

JamSetlist is a service that allows musicians to:

• Display PDF songbooks from Google Drive on Jamsetlist.com and on Fire TV devices
• Record and manage jam sessions
• Organize and access setlists across multiple devices
• Store and playback jam session recordings

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

3. Account Registration

3.1 Account Creation

To use JamSetlist, you must create an account by signing in with your Google account. By creating an account, you represent that:

• You are at least 13 years of age
• You have the authority to enter into these Terms
• All information you provide is accurate and current

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Keep your login information secure
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.3 Account Termination

You may delete your account at any time through your account settings or by contacting support. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Subscription Plans and Pricing

4.1 Free Tier

JamSetlist offers a free tier with the following limitations:

• Maximum of 10 jam sessions
• Basic features and functionality

4.2 Paid Subscriptions

Paid subscription plans may one day be available with enhanced features and higher limits:

• Basic Plan: $4.99/month - Up to 100 jam sessions
• Pro Plan: $9.99/month - Unlimited jam sessions and advanced features
• Sponsor Plan: $999.99/month - We'll come clean your house and garage, then play music for you

Prices are subject to change with 30 days' notice. Price changes will not affect your current billing cycle.

4.3 Billing

Subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. Payments are processed securely through Stripe.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.

4.5 Refunds

Subscription fees are non-refundable except as required by law or at our sole discretion. If you believe you were charged in error, please contact support within 14 days of the charge.

5. User Content and Ownership

5.1 Your Content

You retain all ownership rights to the content you upload or create using JamSetlist, including:

• Your PDF songbooks stored in Google Drive
• Your jam session recordings
• Your setlists and metadata

5.2 License to JamSetlist

By using our service, you grant JamSetlist a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you.

5.3 Content Responsibility

You are solely responsible for ensuring you have the right to use and share any content you access through JamSetlist. You agree not to:

• Upload or share content that infringes on copyrights, trademarks, or other intellectual property rights
• Use the service for any illegal purposes
• Share content that is offensive, harmful, or violates the rights of others

6. Google Drive Integration

JamSetlist integrates with Google Drive to access your PDF songbooks. By using this integration:

• You authorize JamSetlist to access folder and file metadata in your selected Drive folder
• You can revoke this access at any time through your Google account settings
• JamSetlist will only access the specific folders you select
• We do not modify or delete your Drive files

Your use of Google Drive is also subject to Google's Terms of Service and Privacy Policy.

7. Acceptable Use Policy

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service for commercial purposes without permission
• Reverse engineer or attempt to extract source code
• Use automated systems (bots, scrapers) without permission
• Share your account with others
• Abuse our support services

8. Service Availability and Limitations

8.1 Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted or error-free operation. The service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions (Google, AWS, Stripe)
• Circumstances beyond our control

8.2 Storage Limits

Jam session recordings are subject to storage limits based on your subscription plan. We may delete recordings that exceed your plan's limits or after account deletion.

8.3 Support

We provide email support for all users. Response times may vary based on support volume and subscription tier. Support is provided in English only.

9. Intellectual Property

9.1 JamSetlist Property

JamSetlist and its original content, features, and functionality are owned by JamSetlist and are protected by copyright, trademark, and other intellectual property laws.

9.2 Trademarks

"JamSetlist" and our logo are trademarks. You may not use our trademarks without prior written permission.

10. Disclaimers and Limitation of Liability

• Your violation of any rights of another party

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Sending an email notification for significant changes

Your continued use of the service after changes become effective constitutes your acceptance of the new Terms.
